Job Description
Background and Organizational Context

The Gambia has had a successful transition from 22 years of authoritarian rule to an embryonic democratic dispensation. Under the previous regime, serious human rights violations were committed, and justice institutions were systematically manipulated to preserve the regime in power. Justice delivery has been slow and there has been a deficit in access to justice for the population, as well as very limited state support mechanisms or legal aid services available for victims, and defendants. To consolidate democratic governance in The Gambia, the Government in its 2018-2021 National Development Plan (NDP) identified governance as a key priority for reform to assure the durability of peace, transitional justice, and reconciliation. The new administration embarked on several reform initiatives including national reconciliation, constitutional review, and security sector reform.

In December 2017, The Gambia’s Truth, Reconciliation and Reparations Commission was established by an Act of the National Assembly to investigate and establish an impartial historical record of human rights violations that occurred in The Gambia between July 1994 and January 2017 under former President Yahya Jammeh’s rule, grant interim reparations to victims of abuses, recommend persons for prosecution and amnesty, and promote national reconciliation. The TRRC concluded its work and submitted its Final Report to the President in November 2021. Public, particularly victims’, expectations remain high that the final recommendations of the TRRC address their needs and will be implemented by the Government in a timely and comprehensive manner, to achieve justice, including gender-justice, promote national reconciliation and sustainable peace in The Gambia.

The PBF has approved a joint UNDP and OHCHR post-TRRC Project for The Gambia. The project aims to support the transitional justice process with special focus on the recommendations of the TRRC, as well as those coming from civil society, and an overall objective of continuing the process of successful, peaceful democratic transition in The Gambia. The project is expected to support the Government of The Gambia to create awareness of and improve capacities to implement recommendations made by the TRRC using a consultative and participatory approach involving key national institutions such as the Police, Judiciary, National Human Rights Commission, and civil society organizations, with a special focus on victims’ and women’s organizations.

Duties and Responsibilities

Ensure the strategic direction of the post-TRCC Project focusing on achievement of the following results
Support the overall aims and objectives of the post-TRRC project with a focus on providing specialized support to police/prosecutors/magistrates/judges and promote criminal justice cooperation between justice sector actors;
Support and facilitate investigative forums involving prosecutors and investigators directly involved in the investigation and prosecution of post-TRRC crimes;
Keep abreast with the development of new legal trends, as well as intergovernmental mandates.
Ensure effective management of the post-TRCC Project and supervision of the team focusing on quality control of the full cycle of programming achieving the following results
Strategic oversight of planning, budgeting, implementing and monitoring of the project, tracking use of financial resources in accordance with UNDP rules and regulations. Performs the function of Manager Level 1 in Atlas for development projects transactions approval;
Oversee the effective application of RBM, active monitoring of project achievements against indicators, including the implementation on monitoring and evaluation tools for achievement results;
Prepare and deliver all necessary financial and operational revisions and reports, including workplans, in a timely manner. Follow up on audit recommendations. All exceptions are timely reported;
Coordinate the work of and provide guidance to project/programme staff, as needed.
Develop strategic partnerships and support to resource mobilization
Develop and maintain partnerships and cooperation with the Government, as well as relevant experts, international organizations, assistance agencies and donors;
Analyze and research about donors, prepare substantive briefs on possible areas of cooperation, identify opportunities for cost-sharing;
Establish pipelines and mobilize resources for project including ensuring timely donor reporting where necessary;
Lead and support project networking, linkages and partnership development with other UN agencies and development partners.
Provide top-quality policy advisory services to the Government and facilitation of knowledge building and management
Contribute to providing expert prosecution advice and technical assistance with an emphasis on strengthening national criminal justice cooperation, and other related issues;
Provide high-level policy advice to the Country Office (CO);
Analyze the prosecution aspects of the criminal justice system in general and specifically those related to the project including development of required methodology and tools, making necessary visits to study districts for data collection, interviewing staff and other stakeholders;
Analyze data and write relevant analytical reports, share findings.
Perform other work-related duties as assigned

Institutional Arrangement

The Criminal Justice/Prosecutions Specialist will report to the Resident Representative. The Criminal Justice/Prosecutions Specialist will act as the Project Coordinator of the post-TRRC project and supervise UNDP staff in the project management unit (PMU), including a National Rule of Law Specialist, M&E Specialist, Programme Associate and a Driver. The PMU will also include OHCHR staff, namely, a P4 Human Rights Officer and a National Human Rights Officer, who would report to the OHCHR Regional Representative for West Africa and the Sahel.

Required Skills and Experience

Education

Advanced university degree (Master degree) in law, political science, international studies, development studies or a related field.

Experience

7 years experience in leading similar initiatives and demonstrate knowledge of The Gambia ( or another African country) criminal justice system and institutions, including role, functions and interactions between courts, prosecution, and investigation;
Previous experience in project/programme Management in the same field of expertise;
Previous experience in leading teams;
Furthermore, the Criminal Justice/Prosecutions Specialist must have skills in Policy Advice & Technical Assistance and Financial & Operational Management;
Experience in the usage of computers and office software packages (MS Word, Excel, etc)

Language

Fluency in both written and spoken English is required.
